The DAFT Visa: Your Gateway to Europe

What exactly is the DAFT permit?

The Dutch-American Friendship Treaty (DAFT) is a unique agreement from 1956 that allows US citizens to live and work in the Netherlands as entrepreneurs. Unlike other visas, there is no “points system” or requirement to prove your business is of “added value” to the Dutch economy.

Who is eligible for the DAFT permit? 

Any US citizen with a valid passport who intends to start or continue a business in the Netherlands. You must own at least 25% of the company and be actively involved in its operations.


Can I live anywhere in Europe with this?

The DAFT permit grants you residency in the Netherlands. While you can travel freely throughout the Schengen Area (up to 90 days in any 180-day period), your primary home and business must remain in the Netherlands.

What is the minimum investment? 

You must deposit at least €4,500 into a Dutch business bank account. This is not a fee; it is your company’s “working capital.” This balance must be maintained as long as you hold the visa.

Do I need a formal business plan?

Strictly speaking, for the IND (Immigration Service), you do not need a 50-page business plan. However, you must provide an “Opening Balance Sheet” prepared and signed by a Dutch accountant with a BECON number.

Can I work for another company on a DAFT visa? 

As the primary applicant, your permit is tied to your business. You can only work for your own company. If you wish to take a side job as an employee, your employer would need to sponsor a separate work permit (TWV) for you.

Can I get the 30% Tax Ruling? 

Yes, but with a catch. To qualify for the 30% Ruling (where 30% of your salary is tax-free), you cannot be a “Sole Proprietor” (ZZP). You must set up a BV (Limited Company) and meet specific salary and “recruited from abroad” requirements.

Can I bring my family? 

Absolutely. Your spouse/partner and minor children are entitled to “dependent” permits. A major benefit: your family members have full access to the Dutch labor market and can work for any employer without needing a separate work permit.

How long is the DAFT permit valid? 

Initially, it is issued for 2 years. After that, it can be extended for another 5 years, provided your business is still active and the €4,500 investment is intact.

Can I eventually become a Dutch citizen? 

After 5 years of legal residency and passing the civic integration (Inburgering) exams, you can apply for permanent residency or Dutch citizenship.
