What are the criteria to hire a non-EU employee?

As you may know, EEA and Swiss nationals are free to work in the Netherlands without a residence or work permit. However, when your EU employee is on assignment, a Posted Worker notification is required.

What if the candidate you have in mind is a non-EU national?

Employment permits for non-EU employees who are already in the Netherlands

An employer can hire a non-EU employee who is already in the Netherlands in the following cases:

1) highly educated workers with a valid permit (notification to IND required!):

Highly Skilled Migrants (HSM)
EU Blue Card
– When you want to hire a person with an Intra Corporate Transferee (ICT) permit in the Netherlands, you will have to change this to a HSM or EU Blue Card!


2) persons with another valid residence permit containing the note ‘arbeid is vrij toegestaan’(‘permitted to work’);

3) non EU partners of EU citizens, with a valid dependent permit;

3) self-employed persons, provided they carry out the work specified on their residence permit.

4) in some cases, and with Work Permit, refugees.
